These Terms of Service (“Terms”) govern your access to and use of the websites, mobile apps, and venue services operated by Tu Candela Bar LLC (“Tu Candela,” “we,” “us,” or “our”). By using the Services or purchasing a ticket, you agree to these Terms.
Please read these Terms carefully. They contain important provisions, including a binding arbitration clause and class-action waiver (Section 14).
1. Eligibility & age
- You must be at least 21 years old to enter Tu Candela Brickell or purchase a ticket for any event.
- Valid government-issued photo identification is required at the door. No exceptions.
- Entry may be refused to anyone who cannot verify age, appears intoxicated, or violates our house rules.
2. Tickets & bottle service
Ticket purchase
All tickets are sold in U.S. dollars via Stripe. Service fees, taxes, and venue fees may apply and will be disclosed before checkout. Your credit card will be charged at the time of purchase.
Delivery
Tickets are delivered electronically with a unique QR code. You are responsible for keeping your QR code secure and private — anyone presenting it at the door may gain entry.
Resale
Resale of tickets above face value is prohibited. We reserve the right to cancel any ticket we reasonably believe has been resold in violation of these Terms.
Bottle service
Bottle service reservations require a minimum spend confirmed at booking. Minimums are subject to tax and a 20% service charge. Cancellations within 48 hours of the event forfeit the deposit.
3. No refunds
Except as required by law or as stated in our Refund & Cancellation Policy, all ticket sales are final. Tickets are non-refundable and non-exchangeable.
If an event is canceled by Tu Candela and not rescheduled, you are entitled to a refund of the ticket price (excluding third-party fees that are non-refundable). See our Refund Policy for full details.
4. House rules
- Dress code: upscale attire only. No sportswear, athleisure, shorts, tank tops, or beachwear.
- IDs: valid state-issued photo ID or passport required.
- Behavior: harassment, discrimination, violence, or illegal activity will result in immediate removal and a possible ban.
- Drugs & weapons: strictly prohibited. Illegal items are turned over to law enforcement.
- Photography: professional cameras and recording devices require prior approval.
- Capacity: entry is subject to capacity and is not guaranteed after doors open.
Management reserves the right to deny entry or remove any guest at its sole discretion.
5. Photography & media release
By entering the venue, you consent to being photographed, filmed, and recorded, and to the use of your image and likeness in promotional materials, social media, and other marketing by Tu Candela without compensation.
6. Payments
Payments are processed securely by Stripe, Inc. We do not store your full card details on our servers. Chargebacks without prior attempt to contact us may result in account suspension and recovery of fees.
7. SMS & email communications
By providing your phone number or email, you consent to receive transactional communications (confirmations, reminders, door updates) and — if you opt in — marketing messages. Message and data rates may apply. Reply STOP to any SMS to opt out. See our Privacy Policy.
8. Intellectual property
All content, trademarks, logos, and graphics on the Services are the property of Tu Candela Bar LLC or its licensors. You may not copy, reproduce, or use any of it without our prior written consent.
9. User conduct
- Do not attempt to bypass security, scrape, or interfere with the Services.
- Do not impersonate another person or misrepresent your age.
- Do not use the Services for any unlawful purpose.
We may suspend or terminate accounts that violate these Terms.
10. Third-party services
The Services may integrate with or link to third-party platforms (Eventbrite, Posh, Fever, Booking.com, Instagram, TikTok, Stripe, SendGrid, etc.). Those platforms have their own terms and privacy policies, which govern your use of them.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, TU CANDELA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TU CANDELA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID TO TU CANDELA IN THE 6 MONTHS BEFORE THE CLAIM AROSE, OR (b) $100 USD.
13. Indemnification
You agree to indemnify and hold Tu Candela, its owners, officers, employees, and partners harmless from any claim, loss, liability, or expense arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.
14. Governing law, arbitration, class-action waiver
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules.
Binding arbitration. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in Miami-Dade County, Florida. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and Tu Candela each waive the right to participate in a class action, collective action, or representative action. Disputes must be brought individually.
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@tucandela.app with “Arbitration Opt-Out” in the subject line.
15. Changes to these Terms
We may modify these Terms from time to time. Continued use of the Services after changes become effective means you accept the revised Terms.
